These Terms of Service ("Terms") govern your access to and use of the services provided by eSim WL ("we," "us," or "our") through our website at https://esimwl.com. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Service Description

eSim WL is a white-label eSIM platform that enables businesses to launch their own branded eSIM storefronts. Our service allows you to sell and manage eSIM data plans for use in 200+ countries worldwide under your own brand. All products are delivered digitally — we do not ship physical goods. Upon purchase by your customers, they receive a QR code or activation details to install the eSIM profile on their compatible device.

2. Account Registration

To use our services, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

3. Payment Terms

Pricing

Wholesale pricing is determined by your partnership agreement with eSim WL. You set your own retail pricing for your customers. Wholesale prices are subject to change with reasonable notice. The wholesale price applicable at the time of order is the price you will be charged.

Payment Methods

We accept the following payment methods for platform fees and wholesale charges:

• Credit and debit cards via supported payment processors
• Cryptocurrency via supported payment processors
• Other methods as made available on the platform

Refund Policy

Due to the digital nature of our products, refunds are limited to the following circumstances:

• The eSIM profile fails to install due to a technical error on our end
• The eSIM does not activate or provide connectivity in the purchased destination, and our support team is unable to resolve the issue
• Duplicate charges resulting from a payment processing error

Refunds will not be issued for:

• Change of mind after purchase
• Device incompatibility (it is your responsibility to verify compatibility before purchase)
• Unused data or early plan expiration
• Partial data consumption
• Issues caused by incorrect device settings or user error

Refund requests must be submitted within 7 days of purchase to admin@esimwl.com.

4. Acceptable Use Policy

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws
• Misrepresent your brand, pricing, or the nature of eSIM services to your customers
• Attempt to gain unauthorized access to our systems or other partners' accounts
• Use automated tools to scrape, crawl, or extract data from our platform
• Interfere with or disrupt the integrity or performance of our services
• Resell or redistribute platform access without written authorization
• Engage in activities that violate carrier or network operator acceptable use policies

5. White-Label Platform Obligations

As a white-label platform partner, you are responsible for:

• Maintaining your own branded domain and ensuring it points correctly to our infrastructure
• Setting and managing retail pricing for your customers
• Configuring and managing your own payment gateway integrations
• Providing first-line customer support to your end users
• Complying with all applicable consumer protection, data protection, and tax regulations in your jurisdiction
• Ensuring your marketing and communications accurately represent the eSIM services offered

eSim WL provides the technology platform and carrier relationships but does not manage your customer relationships directly.

6. Service Availability

While we strive to provide reliable connectivity and platform uptime, we cannot guarantee:

• Uninterrupted network coverage in all areas of a destination country
• Specific network speeds (4G/5G availability depends on local infrastructure)
• Service availability during network outages, natural disasters, or force majeure events
• Compatibility with all local network operators in a given country

Coverage maps and speed estimates are provided for informational purposes only and do not constitute a guarantee of service quality or availability at any specific location.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• eSim WL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
• Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific service giving rise to the claim in the preceding 12 months
• We are not liable for any loss, damage, or inconvenience caused by factors beyond our reasonable control, including but not limited to network outages, device incompatibility, or third-party service failures

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

8. Intellectual Property

All content on our platform, including but not limited to text, graphics, logos, icons, images, software, and the overall design and arrangement, is the property of eSim WL or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our platform content without our prior written permission, except as necessary to operate your white-label storefront as intended.

9. Termination

We may suspend or terminate your account and access to our services at any time, with or without cause, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent or suspicious payment activity
• Abusive behavior toward our staff or other partners
• Extended account inactivity (12 months or more)

Upon termination, your right to use our services ceases immediately. Any outstanding obligations, including unpaid wholesale charges, remain due.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page. We will update the "Last updated" date at the top of this page to reflect the most recent revision. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
